Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of FMLens, a hosted analysis and release-management platform for FileMaker solutions ("the Service"). The Service is provided by Christo Alberts, trading as Kudrutech, a sole proprietorship operating from Hermanus, Western Cape, South Africa ("Kudrutech", "we", "us", "our"). By accessing or using the Service, you ("you", "your", "Customer") agree to be bound by these Terms.

2. The Service

FMLens ingests FileMaker DDR and SAX exports, compares snapshots, audits solutions for known patterns, generates test packs, and exposes its engine to compatible tooling. The Service does not guarantee bug-free FileMaker solutions, does not provide consulting services unless contracted separately, and does not replace independent technical judgement.

3. Account and registration

You must provide accurate information when registering. You are responsible for the security of your account credentials. One account is permitted per legal entity unless otherwise agreed in writing.

4. Acceptable use

You agree to use the Service in accordance with our Acceptable Use Policy, which is incorporated by reference. In brief: no illegal activity, no reverse-engineering, no abuse of the AI features, no uploading of files you do not have the right to analyse, and no using FMLens to harm third parties.

5. Subscription and billing

Subscriptions are billed by Paddle.com Inc as the Merchant of Record. Plans renew automatically unless cancelled. You can cancel at any time via the customer portal or through our contact page. See our Refund Policy for details on refunds.

6. Intellectual property

FMLens (the software, brand, and documentation) is and remains the intellectual property of Kudrutech. Customer data uploaded to FMLens (your FileMaker DDR exports, custom configurations, and similar) remains your property; we claim no ownership over it. You grant us a limited licence to process your data solely to provide the Service.

See our Privacy Policy for full details on how we handle data. In brief: we store the minimum data needed to operate the Service, we do not sell or share your data, and we use industry-standard security practices (encrypted at rest, encrypted in transit, role-based access control).

8. Confidentiality

Your FileMaker solutions may contain confidential business information. We treat all uploaded data as confidential and do not view, share, or use it for any purpose other than providing the Service to you. Our staff (currently just the founder) access customer data only when required for support purposes and only with your knowledge.

9. Service availability and warranty disclaimer

The Service is provided "as is" and "as available". We make no warranty that the Service will be uninterrupted, error-free, or that it will meet your specific requirements. We will use reasonable efforts to maintain high availability but make no SLA commitment except for Enterprise customers under separate agreement.

10. Limitation of liability

To the maximum extent permitted by law, Kudrutech's total liability under these Terms is limited to the fees paid by you in the 12 months preceding the claim. Kudrutech is not liable for indirect, incidental, consequential, or punitive damages. This includes, but is not limited to, lost profits, lost data, business interruption, or damages arising from third-party claims.

11. Termination

Either party may terminate this agreement at any time. Upon termination, your access to the Service ends, we delete your data within 30 days (unless legally required to retain it), and any unpaid fees become immediately due. Termination does not refund prepaid fees except as set out in the Refund Policy.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated by email to the account contact at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

13. Governing law and jurisdiction

These Terms are governed by the laws of South Africa. Any disputes shall be resolved in the courts of the Western Cape, South Africa, unless we mutually agree to arbitration.
